Terms & Conditions

​​Fees: Our standard fee for an appointment is 30% of the value of the anticipated first year’s compensation package of any individual or team engaged with our assistance. Fees are payable in three parts: on commencement, on delivery of agreed Candidate shortlist and then the balance payable upon formal acceptance of an offer.

Conditions: These terms apply unless varied in writing by us; they are deemed to have been accepted once we start work on an Assignment.

Payment terms: Our invoices are subject to VAT and are payable within 14 days of the date of invoice. We reserve the right to charge interest on unpaid invoices at 4% above the Bank of England base rate

Additional candidates: When more than one Candidate is engaged with our assistance, the standard fee applies to each unless a different fee has been agreed in writing.

Internal or referred candidates: It is integral to our service, when asked, to consider and assess Candidates identified by clients, including internal Candidates from Clients’ organisations. The source of a Candidate do not affect our fee.

Expenses: We do not recharge additional business, travel or administrative expenses unless agreed in advance with our client. If agreed by our client, advertising costs (including copy, creative and booking charges) are payable when the advertising is booked and cannot be refunded unless we are refunded ourselves.

Cancellations: An Assignment may be cancelled at any time, but the fees are non-refundable and a cancellation fee may be charged. If an Assignment is put “on hold” for 3 months or more, we will treat it as cancelled for billing purposes and the cancellation fee will become due and payable. We will agree a new fee if asked to restart.

Verification: For the purposes of the General Data Protection Regulation 2018 we are classed as a “data controller”. We cannot accept responsibility for any inaccuracy in candidates’ own CVs.

Candidate confidentiality: Candidate details sourced by us may not be passed to a third party.

Liability: bpe search (the trading name for Better Placed Executive Recruitment Limited) aims to provide outstanding service and will take all reasonable care in carrying out an Assignment. bpesearch is in no way liable for any act or omission of any Candidate introduced and the Client shall be responsible for making its own appraisal of any Candidate’s ability and character. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this agreement and any liability bpe search may have in connection with any Assignment is limited to the amount of the fee received by bpesearch for that particular Assignment only. bpesearch shall not be liable in any manner for any loss to the full extent such exclusions are permitted by law. bpe search will only accept any liability which may arise if the Client has presented any complaint in writing within a maximum of 4 weeks from the cause of the complaint arising.

Guarantee: If a Candidate leaves our Client within 6 months of appointment (providing this is not the result of redundancy, restructuring or a change in responsibilities, location or reporting lines) we undertake to do the work again without further charge except for any increase in the accepted remuneration and its impact on overall fee. Please note this guarantee only applies where the Client has complied with its obligations to pay our invoices on time in accordance with the Payment terms clause above

Law: These terms shall be governed by and construed in all respects in accordance with English Law and the parties submit to the exclusive jurisdiction of the Courts of England and Wales.
